This summary is for convenience. The full Terms below control.

Thank you for choosing FendPulse. These Terms of Service (the "Terms") explain how FendPulse works, what you can expect from us, and what we expect from you. Please read them carefully, especially Section 3 (Our Commitment and Its Limits), Section 13 (Disclaimer of Warranties) and Section 14 (Limitation of Liability).

---

1. Acceptance of These Terms

1.1 By installing, accessing or using FendPulse (the "Service"), you agree to these Terms and to our Privacy Policy (fendpulse.com/privacy). 1.2 "You" and "Customer" mean the business or organization that installs FendPulse on its Stripe account. If you accept these Terms on behalf of an organization, you confirm that you have authority to bind it. 1.3 Business customers only. FendPulse is sold only to businesses, organizations and professionals for purposes related to their trade or business, not to consumers. By subscribing, you confirm you are acting for business purposes, so consumer-protection rules that apply only to consumers (such as the EU/UK 14-day right of withdrawal) do not apply. You must be at least 18 years old and able to form a binding contract. 1.4 If you do not agree to these Terms, do not install or use the Service. 1.5 International use. You may use FendPulse wherever Stripe and the Stripe App Marketplace are available to you, as long as you comply with the laws that apply to you. 1.6 Sanctions and export. You confirm that you are not located in, organized under the laws of, or ordinarily resident in a country or region subject to comprehensive U.S. sanctions. You also confirm that you are not on any U.S. government restricted-party list (including OFAC's SDN List). You will not use or export the Service in violation of U.S. or other applicable export or sanctions laws.

2. The Service

2.1 Overview. FendPulse is a security monitoring app for the Stripe Dashboard. It reads your Stripe account through the Stripe App permissions you approve, looks for changes and activity that may show risk, and alerts you. FendPulse is read-only. It never creates, changes, pauses or deletes anything in your Stripe account.

2.2 Monitoring features. Your subscription includes all of these:

FeatureWhat it doesHow it works
Payout bank change alertsAlerts when a payout bank account is added, changed or removed on a connected accountStripe events
Card-testing alertsOne grouped alert when declined payments spikeStripe events
Dispute alertsAlerts on new disputes and dispute-ratio thresholdsStripe events and charge history

Early fraud warning alerts are not included.

2.3 Alert channels. Alerts may be delivered by email, by desktop push notification through your web browser, and in the FendPulse view inside the Stripe Dashboard. Alert center features are offered for desktop browsers.

2.4 Planned features. We may add features such as Slack and Microsoft Teams alerts and monitoring for Stripe Connect platforms. Planned features are described for transparency only and are not a commitment to deliver any feature by any date.

2.5 What FendPulse cannot see. Stripe does not give apps access to certain security information. FendPulse therefore cannot detect or alert on: API key creation, exposure or leaks; team member, role or permission changes; Dashboard logins, sessions or sign-in anomalies; or anything outside your Stripe account. Any security checklist we provide for these areas is guidance only.

2.6 One plan. There is one plan with every feature: US$34.99 per month or US$349 per year, as shown at fendpulse.com/pricing and on our Stripe App Marketplace listing.

3. Our Commitment and Its Limits

3.1 Our commitment. Protecting your business matters to us. We commit to doing our absolute best to help you reduce risk on your Stripe account as much as reasonably possible. That means designing FendPulse carefully, monitoring the signals Stripe makes available, and alerting you promptly and clearly. We also commit to improving FendPulse continually as threats change and as Stripe makes new capabilities available.

3.2 Its limits. No monitoring tool can see or stop every threat, and FendPulse is no exception. FendPulse is a risk-reduction tool. It does not, and cannot, guarantee: (a) complete or continuous protection of your Stripe account, funds or business; (b) that every risky event, change or activity will be detected; (c) that any alert will be delivered, or delivered on time; (d) the prevention of any fraud, chargeback, unauthorized payout, account takeover, account restriction, reserve, financial loss or other harm.

3.3 A layer, not a replacement. FendPulse is one layer of your security. It does not replace Stripe's own security features, sound internal controls, or professional security, legal or financial advice.

3.4 Why this matters. Our fees reflect these limits. You agree that you have chosen FendPulse knowing them.

4. Alert Delivery and Third-Party Dependencies

4.1 FendPulse depends on services we do not control. These include Stripe's event delivery and APIs, email providers and inbox filtering, browser and operating-system push services, your device settings, hosting and network providers, and the public internet. 4.2 Alerts may be delayed, duplicated, incomplete, filtered as spam, or not delivered at all. Detection can also produce false positives (an alert about a legitimate change) or false negatives (no alert for a risky event). 4.3 Periodic checks run at set intervals (for example every 10 minutes), so changes found by periodic checks are reported after a delay. 4.4 Desktop push alerts work only if you turn them on, allow notifications in your browser, and keep a supported browser available. You can turn them off at any time. 4.5 We do not guarantee any particular uptime or delivery time. We will make reasonable efforts to keep the Service available and to fix problems promptly.

5. Your Responsibilities

5.1 Acting on alerts. You are solely responsible for reviewing alerts and deciding what to do. That includes checking changes in Stripe and contacting Stripe or your bank when needed. FendPulse gives you information. It does not take action for you. 5.2 Your Stripe security. You remain responsible for securing your Stripe account. This includes strong authentication, managing team access and roles, protecting and rotating API keys, and keeping your contact details current with Stripe. 5.3 Accurate settings. You are responsible for keeping your alert settings, email addresses and notification preferences accurate, and for making sure alerts can reach you. 5.4 Authorized use. You may install FendPulse only on Stripe accounts that you own or are authorized to manage.

6. Acceptable Use and Fair Use

6.1 You will not: (a) use the Service unlawfully, fraudulently or to harm others; (b) attempt to access another customer's data, or to probe, scan or break the Service's security; (c) reverse-engineer, decompile, copy, resell, sublicense or build a competing product from the Service, except as the law expressly permits; (d) interfere with the Service, overload it, or use automated means to access it beyond normal use; (e) misrepresent your identity or your authority over a Stripe account. 6.2 Fair use. Plans are designed for normal business use. If your usage places unreasonable load on the Service, for example excessive alert volume, recipients or API requests, we may contact you and apply reasonable limits. 6.3 We may suspend access immediately if we reasonably believe your use threatens the security, integrity or availability of the Service or other customers.

7. Beta and Preview Features

7.1 We may offer features labeled "beta", "preview", "early access" or similar ("Beta Features"). 7.2 Beta Features are optional, may be incomplete or change without notice, and may be discontinued at any time. 7.3 They are provided strictly "as is", and Section 3 applies to them with even greater force.

8. Subscriptions, Trials, Billing and Cancellation

8.1 Pricing. Current prices are published at fendpulse.com and on our Stripe App Marketplace listing, and the two match. There are no hidden fees, and paid features are clearly identified before you pay. 8.2 Seller of record and billing. Payments for FendPulse are processed through Stripe Managed Payments. Stripe, through its Link service or another Stripe affiliate, is the seller (merchant) of record for your purchase. It is responsible for payment processing and for calculating, collecting and remitting sales tax, VAT and GST where it supports this. Your purchase is also subject to the payment terms shown at checkout. Receipts, invoices and refund notices are sent to you by Stripe/Link. Subscriptions are billed in advance monthly (US$34.99) or yearly (US$349) and renew automatically until cancelled. Your bank statement will show LINK.COM* followed by our name. 8.3 Free trial. New subscribers get one 7-day free trial per Stripe account. Your payment method is collected at checkout. Unless you cancel before the trial ends, your card (or other payment method) is charged US$34.99 for the monthly plan or US$349 for the yearly plan, plus any tax shown at checkout, on day 8, and the plan then renews automatically each month or year until cancelled. We email you a reminder 2 days before that charge with the date, the amount and how to cancel. If you cancel before the trial ends, you are not charged. 8.4 Cancellation. You can cancel any time in the customer portal or by emailing [email protected]. Cancellation takes effect at the end of your current paid period; you keep access until then and are not charged again. 8.5 Refunds. Fees are not refunded and partial periods are not prorated, except where the law requires otherwise or Stripe Managed Payments rules provide a refund. Payment disputes are handled under Stripe Managed Payments rules. 8.6 Price changes. We will give at least 30 days' email notice before any price increase. It takes effect at your next renewal, and you may cancel before then. 8.7 Failed payments. If a payment fails, we may retry it and may suspend the Service until the payment succeeds. 8.8 Taxes. Applicable sales tax, VAT or GST is calculated and added at checkout by the seller of record and shown before you pay. Where Stripe can't take on tax liability in a country, you agree that applicable taxes may be charged or must be self-assessed by you. 8.9 Currency. Prices may be shown and charged in your local currency. Your bank may charge conversion or foreign-transaction fees. 8.10 Payment support. Questions about a charge, receipt or payment method can go to Link support (support.link.com) or to us. Questions about the FendPulse service itself come to us (Section 20).

9. Stripe Is a Third Party

9.1 Stripe, Inc. and its affiliates ("Stripe") are not parties to these Terms and are not responsible for FendPulse. 9.2 Your use of Stripe is governed by your agreements with Stripe. We are not responsible for Stripe's services, events, availability, decisions or changes. Those include account reviews, holds, reserves and restrictions. 9.3 If Stripe changes or withdraws an API, permission or event that FendPulse relies on, we may need to change or remove the related feature. 9.4 FendPulse™ is a trademark of FendPulse LLC. Stripe is a trademark of Stripe, Inc.; FendPulse is not affiliated with or endorsed by Stripe.

10. Data and Privacy

10.1 Our Privacy Policy explains what we read, store, retain and delete, and which service providers we use. It forms part of these Terms. 10.2 You keep all rights in your data. You grant us a limited right to process it only to provide, secure, support and improve the Service, as the Privacy Policy describes. 10.3 We never sell your data, and we do not resell or publish data obtained from your Stripe account. 10.4 We may use aggregated, de-identified information that cannot identify you or your customers to measure and improve the Service. 10.5 Processor terms. For data FendPulse reads from your Stripe account, we act as your processor. A summary of our Data Processing Agreement is at fendpulse.com/dpa, and the full agreement is available on request at [email protected]. 10.6 Security incidents. If we become aware of a security incident that affects your data, we will email the account owner without undue delay and no later than 72 hours after we become aware of it, with what we know, what we are doing and what you can do. 10.7 Subprocessors. Our subprocessors are listed at fendpulse.com/subprocessors. We give at least 30 days' notice on that page and in its RSS feed before a new subprocessor starts processing your data. If you object, tell us at [email protected]; you may cancel before the change takes effect.

11. Confidentiality

11.1 Each party will protect the other's non-public business, technical and account information ("Confidential Information") with reasonable care. Each party will use it only for purposes connected with the Service and will not disclose it, except to personnel and service providers who need it and are bound by similar obligations, or as the law requires. 11.2 Confidential Information does not include information that is public through no fault of the receiving party, already known to it, independently developed, or lawfully received from someone else.

12. Intellectual Property and Feedback

12.1 FendPulse, including its software, design, detection logic, name, logos and content, belongs to FendPulse LLC and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your subscription, in line with these Terms. 12.2 If you send us suggestions or feedback, we may use them freely and with no obligation to you.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE, INCLUDING ALL ALERTS, SCORES, CHECKLISTS AND BETA FEATURES, IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT IT WILL DETECT OR PREVENT ANY EVENT OR LOSS.

14. Limitation of Liability

14.1 TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER FENDPULSE LLC NOR ITS MEMBERS, OFFICERS, EMPLOYEES OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. WE WILL ALSO NOT BE LIABLE FOR ANY LOSS OF PROFITS, REVENUE, FUNDS, DATA OR GOODWILL, OR FOR LOSSES FROM FRAUD, CHARGEBACKS, UNAUTHORIZED PAYOUTS, ACCOUNT TAKEOVER, OR STRIPE ACCOUNT HOLDS, RESERVES OR RESTRICTIONS. THIS INCLUDES LOSSES FROM AN ALERT THAT WAS MISSED, LATE OR INACCURATE, EVEN IF WE WERE TOLD SUCH LOSSES WERE POSSIBLE. 14.2 OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE FEES YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. 14.3 Some jurisdictions do not allow certain limitations. In those jurisdictions, these limits apply to the maximum extent the law permits.

15. Indemnification

You will defend, indemnify and hold harmless FendPulse LLC and its members, officers and employees from third-party claims, damages, losses and costs (including reasonable attorneys' fees) that arise from: (a) your misuse of the Service; (b) your breach of these Terms; (c) your violation of law or of any third party's rights, including Stripe's terms.

16. Suspension and Termination

16.1 By you. You may stop using FendPulse at any time by cancelling your plan (Section 8.4) and uninstalling the app from your Stripe Dashboard. 16.2 By us. We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or legal risk, or if we discontinue the Service. Where reasonable, we will give notice first. If we discontinue the Service entirely, we will give at least 30 days' notice and refund any prepaid fees for the unused period. 16.3 Effect. When the Service ends, your right to use it ends and monitoring stops. Your data is deleted as described in the Privacy Policy. 16.4 Survival. Sections 3, 9 through 15, 17 and 19 survive termination.

17. Governing Law and Venue

17.1 These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. 17.2 Any dispute will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and both parties consent to their jurisdiction. 17.3 Before filing a claim, each party agrees to try to resolve the dispute informally for 30 days after written notice.

18. Changes to the Service and These Terms

18.1 We continually improve FendPulse and may add, change or retire features. If a change materially reduces a feature you rely on, you may cancel, and we will refund the unused portion of your current period. 18.2 We may update these Terms. We will email account owners about material changes at least 14 days before they take effect, and update the effective date above. If you keep using the Service after the effective date, you accept the updated Terms.

19. General

19.1 Notices. We send notices to the email address associated with your account or settings. Send notices to us at [email protected] or by mail to the address in Section 20. 19.2 Entire agreement. These Terms and the Privacy Policy are the entire agreement between us about the Service. 19.3 Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets, with notice to you. 19.4 Severability and waiver. If any provision is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver. 19.5 Force majeure. Neither party is liable for delays caused by events beyond its reasonable control, including outages of Stripe or other third-party services. 19.6 Independent parties. No partnership, agency or employment relationship is created by these Terms. 19.7 Language and translations. These Terms are written in English. Any translation is for convenience only, and the English version controls. Support is provided in English. 19.8 Governing law for international customers. Section 17 (Florida law; Miami-Dade County courts) applies to all customers wherever located, unless mandatory local law requires otherwise. The UN Convention on Contracts for the International Sale of Goods does not apply.
